What it means to be in custody

If you or someone you know has been convicted of Florida state or federal crime and is in custody (in jail or prison, or on probation or parole), a petition for writ of habeas corpus is a civil proceeding used to challenge the judge’s decision that led to the criminal conviction. Petitions can only be filed on behalf of someone who is currently in custody. This is not the same as regular criminal defense.
